Protection of Personal Data

ARGE Österreichischer Mehrweg-Weinflaschen-Pool respects the privacy of users. All information is treated confidentially in accordance with applicable data protection regulations (GDPR, DSG, TKG). Data processing agreements are in place with technical service providers for defined implementation activities; furthermore, your data will not be shared with third parties without your consent. In any case, and in accordance with the applicable legal framework, data processing is carried out on the basis of the statutory provisions of Section 96 (3) TKG and Art. 6 (1) (a) (consent) and/or (f) (legitimate interest) of the GDPR.
ARGE Österreichischer Mehrweg-Weinflaschen-Pool collects personal data only to the extent necessary for a specific purpose. The information will not be reused for any incompatible purpose.

If you contact us by email (info@mehrwegweinflasche.at), the data you provide will generally only be stored for the processing time required to handle the inquiry and in the event of follow-up questions, unless other legal grounds or reporting obligations of the processors to the Österreichisches Ökologie Institut specify different retention periods.

Cookies

The website mehrwegweinflasche.at uses only technically necessary cookies. These are essential for its proper operation.

Server Log Files

Every access to the website mehrwegweinflasche.at is stored in a log file (server logs) containing the following data:

  • IP address of the requesting party
  • Request details and destination address
  • Name of the retrieved file and volume of data transferred
  • Date and time of retrieval
  • Notification of whether the retrieval was successful

These data are used exclusively to ensure system security. No personal evaluation or profiling takes place. The server logs are retained for six months. Data is only transmitted if an attack or illegal access to the internet infrastructure of the Österreichisches Ökologie Institut is suspected and must be forwarded to law enforcement authorities for investigation or prosecution.

Matomo

To analyze (anonymous) user behavior on the websites, the Österreichisches Ökologie Institut uses an open-source web analytics application called Matomo. The analysis is performed on the basis of server logs, but on a strictly anonymous basis. The IP address contained in the server logs is anonymized before the analysis. This ensures that no personal data is present in the analytics system.

You may submit a request for the erasure of your data. You may request the transfer of your data in a machine-readable format. Except in cases of processing based on consent, contract, or existing legal grounds for processing, an objection can be lodged against solely automated decision-making.

You may withdraw any consent you have granted. Any further processing of your data is impermissible from that point forward; however, the lawfulness of processing carried out prior to your withdrawal remains unaffected. The consequences may lead to an inability to process the interests you communicated.

Procurement Procedures: Notwithstanding procurement law requirements to retain data from procurement procedures for at least three years, or for the duration of the subsequent contractual relationship, the long civil law limitation period of 30 years pursuant to Section 1489 ABGB must be observed for retention following the CJEU judgment of November 26, 2015, Case C-166/14, MedEval.

Transfer of Data to a Third Country or International Organization: We do not transfer personal data to entities in third countries or international organizations. However, we use service providers for certain tasks who often also use service providers that may have their registered office, parent company, or data centers in a third country. A transfer is permissible if the European Commission has decided that an adequate level of protection exists in a third country (Art. 45 GDPR). If the Commission has made no such decision, companies or the service provider may only transfer personal data to service providers in a third country provided appropriate safeguards are in place (standard data protection clauses adopted by the EU Commission or the supervisory authority in a specific procedure) and enforceable rights and effective legal remedies are available.

We have also contractually agreed with our service providers that safeguards regarding data protection must always exist with their contractual partners in compliance with the European level of data protection.
